Fired vs. quit usually sets the deadline

Most states run two clocks: a faster one when the employer ends the job (immediately or within a few days, in the strictest states) and a slower one when you quit (often the next regular payday). Giving two weeks' notice doesn't usually change either.

"Wages" can include more than salary

Earned commissions and bonuses that have vested are generally wages. In some states, accrued unused vacation must be paid out too — while others let a clearly disclosed use-it-or-lose-it policy stand.

Late payment can cost the employer extra

Many states impose waiting-time penalties: the employer keeps owing your daily wage for each day the final check is late, up to a cap, on top of the wages themselves. Fee-shifting often makes these claims worth pursuing even when the amount is modest.

Deductions are limited

Employers generally can't hold your final check hostage over unreturned equipment or claimed debts without a valid agreement, and deductions usually can't cut earned wages below the minimum wage. Disputed amounts don't excuse paying the undisputed part on time.

How to claim unpaid final wages

Start with a written demand, then a wage claim with your state labor agency — they investigate and can order payment. Small claims court is the usual backstop, and many wage laws add attorney's fees for workers who win.
